1. Definitions

The general terms and conditions shall apply to all sales of Goods and Services by SERVE CEPTURA SRL through the virtual stores www.shop.serve.ro and www.serve.ro. The document establishes the terms and conditions for using the website and conducting electronic commerce of the products presented on the website Purchasing products from the websites www.shop.serve.ro and www.serve.ro implies full acceptance, each time you access the websites, of the terms and conditions under which the products are provided. SERVE CEPTURA SRL reserves the right to change the Terms and Conditions, as well as the content of the websites, at any time, without prior notification to the Customer. The Customer has permanent access to the Terms and Conditions and is obliged to read the contractual conditions. In case of any misunderstandings, the Terms and Conditions valid at the time of placing the order and its written notification to SERVE CEPTURA S.R.L. shall apply. The Terms and Conditions shall not be applicable to legal entities, whose orders shall be subject to the legal conditions regarding relationships between professionals. The following terms shall mean: User – any person accessing the SERVE.ro website Client – ​​person, firm, company or other legal entity issuing an Order. Seller – the commercial company SERVE CEPTURA SRL, a Romanian company registered with the Trade Register Office attached to the Prahova Court under no. J29/373/1999, with CUI RO 11792232, headquartered in Prahova County, Ceptura commune, no. 125 C, with account no. RO76BRDE450SV71584544500, opened at BRD Groupe Societe Generale SMCC. Goods and Services – any product or service, including the documents and services mentioned in the Order, to be provided by the Seller to the Customer. Order – an electronic document that acts as a form of communication between the Seller and the Buyer by which the Seller agrees to deliver the Goods and Services and the Buyer agrees to receive these Goods and Services and to make payment for them. Contract – an Order confirmed by the Seller, by which the Seller agrees to sell and deliver the Products and Services and the Customer agrees to purchase, receive and make payment for these Products and Services. Courier – any person under public or private law who provides express courier services. Specifications – all specifications and/or descriptions of the Goods and Services as specified in the Order.

2. Intellectual and industrial property rights (IPR)

The content of the serve.ro and shop.serve.ro websites: images, texts, web graphics, scripts, registered trademarks and any other data is the sole property of SERVE CEPTURA SRL., is protected according to the legislation on intellectual and industrial property rights and cannot be taken over, copied or used without the written consent of the owner. The use of any elements on the serve.ro and shop.serve.ro websites without the written consent is punishable according to the laws in force.

3. Order

By launching an electronic order on the serve.ro and shop.serve.ro websites, the Customer agrees with the form of communication (telephone or e-mail) through which the Seller carries out its operations. By completing the Order, the Customer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the Order. When using the service, the Client declares that he will provide real, correct, current and complete information about it, SERVE CEPTURA SRL . not being responsible for the correctness of the data provided in order to prepare the tax invoice. SERVE CEPTURA S.R.L. may refuse an Order following a prior notification addressed to the Client, without any obligations between the parties and without a party being able to claim damages, for the following situations: failure of the online transaction; invalidation of the online transaction; non-acceptance by the issuing bank of the Client’s card / transaction; incomplete or incorrect data of the Client; consecutive failed deliveries; other objective reasons: if the Client does not guarantee that the payment method is valid and that it is not obtained through a fraudulent method or there are suspicions regarding the payment method. The contract is considered concluded between the Client and SERVE CEPTURA S.R.L. upon receipt of the order by the Client, via the courier, and SERVE CEPTURA S.R.L. receives the amount due by the Client. The contract is concluded for a fixed period. It will be considered terminated when the parties have fulfilled their mutual obligations under the terms and conditions established by this document

4. Delivery

These websites are addressed to individuals who are at least 18 years old and have the legal capacity to conclude legal acts, as well as to legal entities. Delivery prThe delivery of the Goods is made on the territory of Romania. By accepting the Terms and Conditions, the Customer declares that he meets the above-mentioned conditions.
The Seller undertakes to deliver the Goods in a door-to-door courier system to the Customer.
The delivery of the products has a national extension area and, thus, will be made anywhere in Romania. SERVE CEPTURA S.R.L. reserves the right to confirm orders, before honoring them, by contacting the customers. The delivery of the products will be free of charge for members of the Knights Club and for orders with a value of the products (product cost minus any discount applied) greater than 250 lei, in any locality on the territory of Romania included in the list of localities covered by FAN Courier. For orders worth less than 250 lei, a standard delivery cost of 35 lei will be added. Shipping costs may vary depending on the delivery address and the quantity of products ordered. The delivery of the ordered products (as well as the accompanying documents) will be made to the address indicated by the Customer, within a maximum of 14 days from the moment of picking up the product by FAN Courier, or any other courier company.
The products are delivered within the limit of the available stock. In the event that one or more of the ordered products are no longer in stock, the Customer will be notified of this, having the option of waiting for the product to become available in stock again or canceling the order. In some cases, the ordered product can be replaced with a similar one if you wish and agree to this. In the event that the Customer decides to cancel the order, SERVE CEPTURA SRL will refund the amounts paid by the Customer for the unavailable products within a maximum of 14 days from the date of becoming aware of the decision to cancel the order.
The responsibility for any loss or damage caused to the product, parcel or package sent by us, rests with the courier company or carrier according to the legislation in force. The products will be replaced by us if the courier’s fault is proven and we will be notified in writing within 24 hours of receiving the package, clearly indicating the products that were lost or damaged and the reason for the replacement request.
SERVE CEPTURA SRL reserves the right to delay or cancel deliveries of ordered products if they cannot be honored for reasons beyond SERVE CEPTURA SRL’s control, including: fires, explosions, floods, epidemics, strikes, government actions, wars, acts of terrorism, protests, riots, civil unrest or other force majeure impediments, according to the customs of Romanian law.
If the customer is not found at the mentioned address, within the mutually agreed upon time frame, our courier will return once more after re-establishing contact with the customer, at which point the order will be cancelled and the product returned to the premises, the customer will bear the costs of a new delivery, regardless of the value of the ordered products.
SERVE CEPTURA SRL reserves the right to refuse any order placed on the websites www.shop.serve.ro and www.serve.ro, as well as to limit the quantity of products ordered or to cancel any order to the extent that it considers that they are contrary to its interests or the website www.shop.serve.ro and www.serve.ro. These restrictions may include limitations on the quantities of products that can be ordered at a given time by one or more Customers or/and orders placed by or under the same Customer account, the same credit card and/or orders that use the same billing and/or shipping address.

5. Price

The prices shown include VAT (21%), but do not include delivery costs, unless expressly specified on the site. The purchase price printed on the invoice will be the same as that presented on the shop.serve.ro website. at the time of purchase.

6. Invoicing –Payment

The price, payment method and payment term are specified in the Order. The Seller will issue an invoice to the Customer for the Goods and Services delivered, the Customer’s obligation being to provide all the information necessary to issue the invoice according to the legislation in force. The price of the purchased products is the one specified in the “Total” column, where you view the contents of the “Cart” – top right.

7. Return policy

The return of the product/products ordered and delivered can be done physically, by personally handing it/them over by the customer or by sending them via FAN Courier, within 14 calendar days from the date of delivery, to the address: Soseaua Pipera no. 50 A, Sector 2, 020309 Bucharest
The product/products proposed for return must be in the same condition in which they were delivered by SERVE (sealed, in the original packaging and box, with the labels intact and complete). with all accompanying documents – invoice, tax receipt or other documents). Otherwise, SERVE has the right to refuse the return of the products and, implicitly, the refund of the value. Products that show signs of damage or wear, damaged or incomplete packaging, missing original box, etc. are not accepted. We recommend returning the product/products in the original packaging because it offers increased protection. SERVE does not assume responsibility for products damaged during transport. The value of the products ordered, delivered by SERVE CEPTURA S.R.L. and subsequently returned by the customer, under the above-mentioned conditions, will be refunded exclusively by bank transfer, to the account sent by e-mail by the buyer, within 14 working days from the date of receipt of the return.

8. Confidentiality

Information of any nature provided by the Customer to the Seller will remain the property of the Seller. When a User creates an account on serve.ro, he will receive commercial communications only to the extent that he has given his express consent by selecting the appropriate option. The data collected regarding newsletters and alerts are confidential. SERVE CEPTURA S.R.L. will be able to select the Users to whom it will send newsletters and alerts. No public statement, promotion, press release or any other way of disclosure to third parties will be made by the Client regarding the Order/Contract without the prior written consent of the Seller.

9. Liability

The Seller cannot be held liable for damages of any kind that the Client or any third party may suffer as a result of the Seller’s fulfilment of any of its obligations under the Order and for damages resulting from the use of the Goods and Services after delivery and in particular for their loss. By creating and using the Account, the Client / User / assumes responsibility for maintaining the confidentiality of the Account data (username and password) and for managing access to the Account, and, to the extent permitted by applicable law, is responsible for the activity carried out through his/her Account. By creating the Account and/or using the Content and/or placing Orders, the Client / User / expressly and unequivocally accepts the Terms and Conditions of the Site in the latest updated version that is communicated within the Site, existing on the date of creating the Account and/or using the content and/or on the date of placing the Order. After creating the Account, the use of the Content is equivalent to accepting the changes made to the Terms and Conditions of the Site and/or the updated versions of the Terms and Conditions of the Site. The Terms and Conditions of the Site may be modified at any time by SERVE CEPTURA S.R.L., and they are enforceable against the Clients / Users / from the date of display on the Site. Acceptance of the Terms and Conditions of the Site is confirmed by checking the corresponding checkbox on the Site and/or by sending the order.

10. Conflict resolution

The contract will be governed and interpreted in accordance with Romanian law. Any conflict arising between SERVE CEPTURA S.R.L. and the Clients will be resolved amicably. If this is not possible, the first avenue of resolution is mediation, under the terms of the law, and if this fails, the Romanian courts at the Seller’s headquarters will be consulted. 11. Use of the site by persons under 18 years of age The legislation in force prohibits minors from purchasing alcoholic beverages, therefore, when using this site, any user declares on his own responsibility the following: “I declare on my own responsibility that I am at least 18 years of age and that by placing the order I do not violate the legal provisions in force”.
